Terms of Use & Service Agreement

Applicable Law: The laws of Sharjah Media City (SHAMS), the Emirate of Sharjah, and the Federal Laws of the United Arab Emirates.

1- Acceptance of Terms

By accessing or using the My Geenio website (“the Service,” “we,” “us,” or “our”), you agree to be bound by these Terms of Use (“Terms”). If you disagree with any part of the terms, you must not use the Service. My Geenio reserves the right to update or modify these Terms at any time without prior notice.

2- The Service (Platform Disclaimer)

My Geenio operates solely as an online classified advertisement platform to facilitate communication between individuals who want to buy and sell goods and services.

YOU ACKNOWLEDGE AND AGREE THAT:

• We are not a party to any transaction. We are not involved in the actual transaction between buyers and sellers. We do not inspect, endorse, or verify the quality, safety, or legality of the items or services listed, the truth or accuracy of the content, or the ability of sellers to sell items or buyers to pay for items.
• We assume no liability for any content, actions, or omissions of users, and any transactions conducted on or through the Service are done at your own risk.

3- User Accounts and Eligibility

• Eligibility: You must be at least 18 years old and capable of entering into a legally binding contract under UAE law to create an account.
• Account Security: You are solely responsible for maintaining the confidentiality of your account login information, including your password and access via Facebook Login. You must notify us immediately of any unauthorized use of your account.
• Account Termination: We reserve the right to suspend or terminate your account and your access to the Service at our sole discretion, without notice, for any reason, including any breach of these Terms.

4- User-Generated Content (UGC) and Prohibited Content

UGC refers to all content, including text, images, videos, pricing, and descriptions, that you upload or submit to the My Geenio Service.

4.1- License Granted by User

By submitting UGC, you grant My Geenio a non-exclusive, worldwide, royalty-free, perpetual, transferable, and sub-licensable right to use, reproduce, modify, adapt, publish, display, distribute, and archive the UGC in connection with the Service and its marketing.

4.2- Prohibited Content and Conduct (UAE Compliance)

You are solely responsible for your UGC and must ensure it complies with all Federal Laws of the UAE. You agree not to post, upload, or transmit any content that:

1. Violates UAE Public Morals or Religious Values: Content that is obscene, pornographic, promotes vice, or offends divine religions, Islamic beliefs, or any other legally protected religion in the UAE.
2. Infringes Intellectual Property: Content that infringes on any copyright, trademark, patent, or other proprietary rights of any third party.
3. Promotes Illegal or Prohibited Goods: Advertisements for prohibited items or services under UAE law, including but not limited to: tobacco products, alcoholic beverages, narcotics/controlled substances, unlicensed financial services (e.g., unauthorized forex/pyramid schemes), gambling, or any product/service requiring a specialized license that you do not possess.
4. Is Defamatory or Harassing: Content that is false, libelous, abusive, harassing, threatening, discriminatory, or invades the privacy of any person.
5. Promotes Fraud/Phishing: Content used in practices of deception, fraud, impersonation, or witchcraft/sorcery.

5- Payments, Fees, and Refund Policy

• Fees: Certain features of the Service (e.g., “Featured Ad” placement, premium subscriptions) may be subject to fees. You agree to pay all applicable fees and charges for your use of the Service.
• Payment Processing: All payments are processed through third-party payment gateways (e.g., WooCommerce). We are not responsible for errors, unauthorized access, or security issues on these third-party platforms.
• Refunds: All fees paid for classified ad placements or premium features are generally non-refundable. Any exceptions or disputes regarding refunds shall be at the sole discretion of My Geenio, in line with applicable UAE consumer protection laws.

6- Intellectual Property

The Service (excluding UGC) and its original content, features, and functionality are and will remain the exclusive property of My Geenio and its licensors. You may not copy, reproduce, or use any trademarks, logos, or content of My Geenio without our prior written consent.

7- Disclaimers and Limitation of Liability

The following clauses limit My Geenio’s liability to you, as permitted by UAE law:

• “As Is” Service: The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
• No Warranty on Ads: We make no warranty or representation regarding the truthfulness, accuracy, quality, success, credibility, or legality of any classified advertisement or message published on the Service.
• Limitation of Liability: To the maximum extent permitted by applicable law, My Geenio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the Service; (ii) any conduct or content of any third party on the Service; (iii) any unauthorized access, use, or alteration of your content.

8- Indemnification

You agree to defend, indemnify, and hold harmless My Geenio, its employees, agents, and affiliates, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from: (i) your use of and access to the Service; (ii) your breach of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your UGC caused damage to a third party.

9- Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the Sharjah Media City (SHAMS), the Emirate of Sharjah, and the Federal Laws of the United Arab Emirates. You agree to submit to the exclusive jurisdiction of the courts of Sharjah to resolve any legal matter arising from these Terms.
